Welcome to Maraki. These Terms of Service ("Terms") govern your use of marakiflorals.com (the "Site") and any purchase you make from us. "Maraki," "we," "us" and "our" refer to MARAKI (operated by Kunming Jiuning Trading Co., Ltd.), based in Dounan, Kunming, Yunnan, China, the heart of China's flower trade and the source of our preserved flowers. By using the Site or placing an order, you agree to these Terms, our Refund Policy, our Shipping Policy and our Privacy Policy. Please read them carefully.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree that the information you give us is accurate and complete.

2. Our products

  • Our arrangements are made with preserved flowers, which are real flowers. They need no water and no care, and they're made to last a year. Over time, their colors naturally soften. Keep them away from direct sunlight, heat and humidity.
  • Every piece is handmade to order. Bloom size, shape, color and placement may vary slightly from the photos. Colors can also look different on different screens. These natural variations aren't defects.
  • Our pieces are decorative and not meant to be eaten. Keep them away from children and pets who might chew on them, and away from open flames.
  • If a particular flower or vase isn't available, we may substitute one of similar style, color and value. We'll contact you first if the change is noticeable.

3. Orders

When you place an order, you make an offer to buy. We accept it when we send your order confirmation email. We may decline or cancel any order, for example because of an obvious pricing or listing error, suspected fraud, or a product that's no longer available. If we cancel an order, we'll return any payment in full to your original payment method.

4. Prices and payment

Prices are shown in U.S. dollars. Shipping is free, and duties and import fees are included. Any applicable sales tax is shown at checkout. Payments are processed by our third-party payment providers. We don't store your full card details. We may change prices at any time, but changes never affect orders we've already confirmed.

5. Shipping, title and risk

We deliver as described in our Shipping Policy. Delivery times are estimates, not guarantees. Ownership and risk of loss pass to you when the carrier delivers your order. Until then, any transit damage or loss is covered by our Arrives-Perfect Guarantee.

6. Returns, cancellations and the Arrives-Perfect Guarantee

Every piece is handmade to order, so we don't accept returns for a change of mind or other personal reasons. Our Refund Policy explains cancellations and the Arrives-Perfect Guarantee. It is part of these Terms. Nothing in these Terms limits our Arrives-Perfect Guarantee or any rights you have under applicable law that can't be waived.

7. Bespoke commissions

Bespoke and custom pieces are made to the design we agree with you in writing. That agreement sets the price, any deposit and the timeline, and it controls if it differs from these Terms. Once production starts, the deposit is non-refundable. Bespoke pieces are final sale.

8. Reviews and content you share

If you send us reviews, photos or other content, you confirm that it's yours to share. You also give us a non-exclusive, royalty-free license to use, reproduce and display it in connection with Maraki. We don't edit reviews to change their meaning, and we may decline to post content that's abusive, unlawful or unrelated to our products.

9. Intellectual property

All content on the Site belongs to Maraki or our licensors and is protected by law. This includes our designs, photos, text, logos and the Maraki name. You may not copy, reproduce or use it for commercial purposes without our written permission.

10. Use of the Site

You agree not to misuse the Site. This means you won't interfere with its security or operation, use it for any unlawful purpose, place fraudulent orders, or scrape or copy its content by automated means.

11. Third-party services

The Site may link to or use third-party services, such as payment providers, DHL tracking and messaging apps. Those services have their own terms, and we're not responsible for them.

12. Disclaimers

Except as expressly stated in these Terms and our policies (including the Arrives-Perfect Guarantee), and to the fullest extent permitted by law, the Site and our products are provided "as is." We disclaim all other warranties, express or implied. Some states don't allow certain warranty exclusions, so some of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Maraki isn't liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order won't exceed the amount you paid for that order. Nothing in these Terms excludes liability that can't be excluded by law.

14. Indemnification

You agree to indemnify and hold Maraki harmless from claims arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.

15. Resolving disputes

If something goes wrong, please contact us first at maraki060606@gmail.com. We reply within 24 hours, and most issues can be resolved quickly and informally. If we can't resolve a dispute within 30 days, either of us may pursue it as allowed under Section 16.

16. Applicable law

If a dispute arises, we'll first try to resolve it with you in good faith, as described in Section 15. These Terms apply and are enforced to the extent permitted by applicable law, and nothing in them takes away rights you have under the laws where you live.

17. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver. These Terms and our policies are the entire agreement between you and Maraki about your use of the Site and your purchases. If a translated version differs from the English version, the English version controls.
